Terms of Use

1. Overview

MicMind is an AI-powered content creation assistant for iOS that transforms your ideas into polished, platform-ready posts for Twitter/X, Reddit, LinkedIn, and blogs. The App provides voice recording with speech-to-text transcription, AI-powered content generation, translation, image generation, an interactive 3D Digital Garden, analytics, and content management features.

2. Eligibility

• You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App.
• If you are under 18, you must have permission from a parent or legal guardian.
• By using the App, you represent that you meet these requirements.

3. Account Registration

• You must create an account using Apple Sign-In or Google Sign-In to use the App.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information during registration.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the App to:

• Generate, solicit, or distribute illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Attempt to bypass safety filters, manipulate AI responses for harmful purposes, or exploit the AI system
• Impersonate any person or entity, or misrepresent your affiliation
• Interfere with, disrupt, or overload the App's servers or infrastructure
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App for automated or bulk messaging, scraping, or data extraction
• Share your account credentials with others
• Use the App to harm minors in any way
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate your access if you violate these Terms.

5. AI-Generated Content

5.1 Nature of AI Responses

• The App uses AI language models to generate content variations including tweets, threads, Reddit posts, LinkedIn posts, and blog articles.
• AI-generated content is created automatically and is not reviewed by humans before delivery.
• AI-generated content may contain inaccuracies, errors, or biases.

5.2 AI Image Generation

• The App generates custom images in four styles (Vintage Woodcut, Vaporwave, Minimalist, Futuristic 3D) using AI models.
• Generated images are for your personal and commercial use in your social media posts.
• We do not guarantee that generated images will be free from resemblance to existing works.

5.3 AI Learning & Personalization

• The App uses an upvote/downvote feedback system to learn your content preferences.
• AI personalization data (preferred tone, format, hashtags, content length) is stored on your account and used solely to improve your experience.

5.4 Content Responsibility

• You are solely responsible for reviewing and publishing AI-generated content on any platform.
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content for any platform.
• You are responsible for ensuring that published content complies with the terms of service of each social media platform.

6. Voice Features & Speech-to-Text

• The App offers voice recording with live waveform visualization and real-time speech-to-text transcription.
• Speech-to-text supports 12+ languages including English, Turkish, German, French, Spanish, Italian, Japanese, Korean, and Hindi.
• Voice input is processed using Apple's on-device Speech Recognition framework.
• By using voice features, you consent to audio processing as described in our Privacy Policy.
• Voice features require microphone and speech recognition permissions on your device.

7. Translation Services

• The App provides instant translation to 190+ languages.
• Translations are generated automatically and may not be perfectly accurate in all contexts.
• You are responsible for verifying translation accuracy before publishing translated content.

8. Credits & Payments

8.1 Credit System

• The App operates on a credit-based system. Credits are required to use AI content generation features.
• Credit packages are available for purchase through Apple's In-App Purchase system.

8.2 Purchases

• All purchases are processed by Apple through the App Store.
• Prices are displayed in your local currency and may vary by region.
• Purchases are subject to Apple's App Store Terms of Service.

8.3 Refunds

Refund requests must be directed to Apple through their standard refund process, as all payments are processed by Apple. We do not process refunds directly.

8.4 Credit Expiration

• Purchased credits do not expire as long as your account remains active.
• Credits are non-transferable between accounts.

9. Digital Garden & Analytics

• The 3D Digital Garden is a visual representation of your creative journey within the App.
• Analytics features (readability scores, sentiment analysis, engagement prediction) are provided for informational purposes only.
• We do not guarantee the accuracy of engagement predictions or analytics metrics.

10. Apple Watch & Widgets

• The Apple Watch companion app and home screen widgets are optional features.
• Widget and Watch data is synced locally and may have a slight delay.
• These features require additional system permissions on your device.

11. Intellectual Property

11.1 Our Property

• The App, its design, code, branding, and all related materials are the intellectual property of AIFlow Apps.
• You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

11.2 Your Content

• You retain ownership of the content you input into the App (voice recordings, text, photos, videos).
• By using the App, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the service.

11.3 AI-Generated Content

• AI-generated posts, articles, and images are provided for your personal and commercial use.
• We make no claim of ownership over AI-generated content, but we also make no guarantees regarding intellectual property rights of such content.

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your data.

13. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that:

• The App will meet your specific requirements
• The App will be available at all times without interruption
• AI-generated content will be accurate, complete, or appropriate for any platform
• Translations will be perfectly accurate
• Errors or defects will be corrected

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claims related to the App shall not exceed the amount you paid to us in the 12 months preceding the claim.
• We are not liable for any damages resulting from: AI-generated content or recommendations, content published on third-party platforms, unauthorized access to your account, service interruptions or data loss, or actions taken based on AI-generated content.

15. Indemnification

You agree to indemnify, defend, and hold harmless AIFlow Apps and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you publish on third-party platforms using the App

16. Termination

• You may stop using the App at any time by deleting your account or uninstalling the App.
• We may suspend or terminate your access at any time, with or without cause, with or without notice.
• Upon termination, your right to use the App ceases immediately.
• Unused credits may be forfeited upon account termination for Terms violations.
• Sections 5, 11, 13, 14, and 15 survive termination.

17. Modifications

• We reserve the right to modify these Terms at any time.
• Updated Terms will be posted within the App with a new "Last Updated" date.
• Continued use of the App after changes constitutes acceptance of the modified Terms.
• If you do not agree with the modified Terms, you must stop using the App.

18. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey.
• Any disputes arising from these Terms shall be resolved in the courts of Istanbul, Turkey.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIFlow Apps regarding your use of the App and supersede any prior agreements.
